Terms of Service

1. Who we are
Wednesday Table is operated by [COMPANY NAME], the operator of Wednesday Table ("we", "us"). These Terms of Service (the "Terms") are an agreement between you and us about your use of the Wednesday Table website, the phone app and the services they provide (together, the "Service").
2. Accepting these Terms
By creating an account, tapping Continue on the welcome screen, or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Service. You must be at least 18 years old to hold an account.
3. Your account
You need an email address to hold an account. Sign-in is by a link or a code sent to that address, or by a password if you set one. Keep your email account secure: anyone who can read it can sign in as you. Tell us at hello@wednesdaytable.com if you believe someone else has used your account.
You are responsible for what is done through your account. Give us accurate information and keep it current.
4. What the Service does
The Service lets people find and sign up for games of American Mah Jongg, run clubs, leagues, open plays and tournaments, keep score and standings, and send messages about those days. Clubs, leagues, open plays and tournaments are organized by their own leaders, hosts and directors, not by us. We provide the tools; they decide who plays, where, when and by what rules.
5. Leaders, hosts and directors
If you run a club, league, open play or tournament on the Service, you are responsible for what you organize, including the venue, any fees you collect, the rules you apply, and the messages you send through the Service. You agree to send only messages the members of your group would expect from you, and to honor requests to stop.
6. Acceptable use
You agree not to use the Service to harass anyone, to send unsolicited messages, to collect other people's information for purposes outside the Service, to interfere with the Service or its security, or to break any law. We may suspend or close an account that does these things.
7. Your content
Names, messages, posts, photos and scores you add to the Service remain yours. You give us permission to store, display and send them as needed to run the Service, for example to show your name on a list of who is in, or to send your club's message to its members.
8. Paid features
Some features are paid. Prices, what is included and the billing terms are shown where you buy them. Except as required by law or stated at purchase, fees are not refundable.
9. Your record stays
The Service keeps a record of the days you played and the scores posted, because other people's standings depend on them. If you close your account, your personal details are removed and the record is kept under a closed account, as described in the Privacy Policy.
10. Availability and changes
We work to keep the Service available, and we may change, suspend or discontinue any part of it. We will give reasonable notice of changes that matter to you where we can.
11. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted or error-free, or that scores and standings will be free of mistakes made at the table.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim, or one hundred US dollars, whichever is greater.
13. Indemnity
You agree to defend and indemnify us against claims arising from your breach of these Terms or from a club, league, open play or tournament you organize.
14. Ending the agreement
You may close your account at any time from Settings. We may suspend or close your account for a breach of these Terms. Sections 7, 9 and 11 through 16 survive.
15. Governing law and disputes
These Terms are governed by the laws of [the State of Texas], without regard to its conflict of law rules. [Counsel to specify venue, arbitration or class-action terms.]
16. Changes to these Terms
We may update these Terms. When the change matters, we will ask you to accept the new version the next time you sign in. Continued use after that is acceptance.
